Dynamic Collective Pty Ltd t/a Dynamic Floor Plans provides services on the following terms and conditions.

1. Introduction

We, us, or our is a reference to Dynamic Collective Pty Ltd t/a Dynamic Floor Plans

You or your is a reference to the person or business to whom we are providing our Services and who is responsible for payment

Parties is a reference to both us and you

2. Our Services

Dynamic Floor Plans provides professional Property Marketing Floor Plan services. This includes the onsite measurement of properties and floorplan design, based on either our onsite measurements or on architectural drawings or property information provided by the client.

(a) Floorplans are delivered in digital format unless otherwise agreed.

(b) We aim to return completed floorplans within 2 business days of the onsite visit or receipt of final materials. Faster turnaround may be available on request but is not guaranteed.

(c) We reserve the right to update, modify, or discontinue services at any time without notice or liability.

3. Bookings, Rescheduling & Cancellations

(a) Bookings can be made online or in writing and are confirmed once scheduled.

(b) If an onsite appointment is cancelled or rescheduled with less than 24 hours’ notice, we reserve the right to apply a cancellation fee of up to 50% of the quoted service fee.

(c) If we are unable to access the property at the scheduled time (e.g. locked gates, unresponsive tenants, unsafe site), we reserve the right to apply a rebooking fee of up to 50% of the original service fee.

4. Client Responsibilities

(a) It is the client’s responsibility to ensure:

(i) Timely and safe access to the property at the scheduled time

(ii) The property is in a safe, accessible condition for our technician

(iii) Any plans, measurements, or other materials provided are accurate and up to date

(b) Inaccurate or incomplete information may lead to delays or additional charges.

5. Fees and Payment

(a) Our fees are outlined in our official price list, which is distributed to clients and updated periodically. Custom pricing may be quoted for unique properties or special requirements.

(b) Invoices are issued upon delivery and are payable within 14 days.

(c) We reserve the right to apply a late payment fee of $5.00 AUD per calendar day on any overdue invoices.

(d) The party that places the booking is liable for payment. Where bookings are made by an agent or representative, the business or agency they represent is responsible for payment unless otherwise agreed in writing.

(e) If payment is not received within 30 days, we may take recovery action. The client agrees to cover any reasonable costs associated with debt collection, including legal fees.

6. Intellectual Property & Usage Rights

(a) All floorplans remain the intellectual property of Dynamic Floor Plans, unless otherwise agreed in writing.

(b) The client is granted a non-exclusive, non-transferable license to use the floorplans solely for marketing the property they were created for.

(c) Floorplans may not be reused for other listings, resold, or altered without our written consent.

(d) Any version supplied with our branding must retain those marks unless otherwise approved.

7. Accuracy & Limitations of Liability

(a) Floorplans are created as visual marketing aids only. They are not suitable for construction, legal, or architectural purposes.

(b) We strive for accuracy and detail, but all floorplans should be carefully reviewed by the client before use. If adjustments are needed, we encourage prompt contact so we can assist.

(c) To the maximum extent permitted by law, we exclude liability for:

(i) Indirect or consequential losses

(ii) Delays or errors resulting from third-party information, access issues, or changes made after delivery

(iii) Use of the floorplan beyond the original purpose or intent

(d) If liability arises, our total responsibility is limited to the amount paid by you for the relevant service.

8. Changes to These Terms

(a) We may update these Terms and Conditions at any time. The most current version will be available on our website and provided to clients upon request.

9. Governing Law

(a) These Terms are governed by the laws of Queensland, Australia. Any    disputes arising from these Terms will be handled under the jurisdiction of Queensland courts.
